Boreholes requiring authorisation under water law

Drilling through groundwater-protecting layers, several groundwater levels or into pressurised water requires a permit under water law.

Course description

The water law permit for drilling work requiring authorisation must be applied for in good time before the planned start of work. This work includes, for example, groundwater measuring points, exploratory drillings and ground soundings.

For the compilation of complete and verifiable application documents, please refer to the leaflet "Application documents for boreholes requiring authorisation" from the Munich Water Management Office (available under "Documents and links").

If boreholes are developed into groundwater measuring points, the specifications of the leaflet "Minimum criteria for the construction of groundwater measuring points" of the Munich Water Management Office, which can be found under "Documents and links", must be observed.

Boreholes that only tap the first or quaternary groundwater storey are only subject to notification. (see link to the drilling notification "Drilling and work in groundwater" under "Documents and links")

The extraction of groundwater for pumping tests is not subject to authorisation up to a duration of 144 hours. Longer periods or tests on several wells at the same time lasting longer than 72 hours are subject to authorisation.

As a rule, a separate water law procedure must be carried out for subsequent utilisation of the groundwater tapped by the well.

The documents are required in digital form and also in paper form in triplicate.

Duration and costs

Processing time

The duration of the procedure is several months and depends on the individual case, the fulfilment of all requirements for approval and the additional processing time for other specialist departments involved in the procedure.

Fees and charges

at least 100 euros up to a maximum of 15,000 euros
