Change of operator for installations handling substances hazardous to water

If the operator of a system subject to inspection in accordance with Section 46 AwSV changes, this must be reported.

Course description

After a change in the person or organisation operating a system for handling substances hazardous to water that is subject to mandatory testing, the new operator must immediately notify the competent authority in writing of this change in accordance with Section 40 (4) AwSV (Ordinance on Systems for Handling Substances Hazardous to Water).

This is not mandatory for heating oil consumer systems. However, the Water Law Department of the City of Munich requests that the new responsible person be notified in this case as well, as this makes the work considerably easier.

Please note

Please note

The notification can be made via the online service or informally by e-mail.

Required documents

Inspection report by an AwSV expert for the facility handling substances hazardous to water for which the change of operator is to be reported.

Alternatively: Details of the new person or organisation that will operate the facility in future, the location of the facility, the former operator and information on the facility (e.g. type of facility, volume, water-polluting substances, water hazard class, etc.).

Legal basis

§ Sections 62 and 63 of the Federal Water Act (WHG)
