Tree felling - protected landscape areas

If you want to cut down a tree or make other changes to a tree in a landscape conservation area, you must submit an application.

Course description

Tree felling and changes to trees and shrubs in landscape conservation areas and protected landscape features in the Munich city area must be applied for. This application must be submitted to the Lower Nature Conservation Authority in the Department for Climate and Environmental Protection.

Outside of protected areas, the Department of Urban Planning and Building Regulations is responsible. You can find more information on this under Tree felling - Protected tree species.

In the protected areas, you must submit an application for all tree species. The restrictions of the Tree Protection Ordinance do not apply in the protected areas.

Prerequisites

Any person affected can submit an application. The applicants also bear the costs.

If there is an acute danger, the necessary measures to avert danger can be taken without prior written authorisation from the Lower Nature Conservation Authority. An acute danger is, for example, a crack in the ground, a raised root plate or a sudden inclination; in this case, please submit written confirmation from a specialist company to the Lower Nature Conservation Authority within two weeks of carrying out the measure. The confirmation should contain the following

  • Proof of the acute danger
  • meaningful photographic material
  • Information on when the measure was carried out

Required documents

For a successful application, you will need the completed application form.

Photographic documentation of the damage can facilitate processing. The same applies to existing expert reports.

Duration and costs

Processing time

Processing takes two to three months, depending on the volume of applications.

Fees and charges

The costs for the service range from 50 to 5,000 euros.

The amount of the fees depends on the number of trees and shrubs or the number of expertises to be carried out and whether a site inspection was necessary.

An invoice is enclosed with the decision. The payment modalities are also noted there.

Tree felling - Protected tree species

In Munich, certain trees are specially protected by the Tree Protection Ordinance. These trees may only be cut down or pruned with authorisation.

Water law permit - geothermal probe/ geothermal collector

A permit under water law is required for the construction of a geothermal system (probe, collector, baskets or similar) with groundwater contact.

A water law permit is required for the erection or extension of structures in an identified and mapped floodplain.

Completion of the replacement planting

If you have felled a tree, a replacement planting may be required as compensation. The completion of this replanting must be reported.

Report tree damage (during construction work)

If trees are damaged without authorisation, owners or polluters can be obliged to restore or plant replacement trees.
