Residence permit – adolescents and young adults

Tolerated persons or holders of the right of residence between the ages of 14 and 26 can receive a residence permit if they have integrated well.

Description

On 31 December 2022, the so-called Opportunity Residence Act came into force. Persons with tolerated status can obtain a residence permit under simplified conditions.

The residence permit is issued and extended for a maximum of three years. You must apply for a residence permit before your tolerated stay or residence title expires.

Spouses, life partners and underage unmarried children should also be granted a residence permit for a shorter period of stay, provided that a family cohabitation exists and the conditions for granting the permit are met.

Prerequisites

  • Registration of main residence in Munich
  • Valid national passport or at least clarified identity
  • Possession of a residence permit in accordance with § 104c AufenthG or possession of a tolerated stay permit for at least 12 months
  • Uninterrupted legal residence of three years in the federal territory
  • Age limit: at least 14 years old and at most 26 years old
  • Successful school attendance of three years or acquisition of a domestic school or vocational school qualification
  • Security of livelihood
  • Commitment to the free democratic basic order
  • Integration into the living conditions of the Federal Republic of Germany
  • the application for a residence permit must be submitted before the age of 27
  • If underage children are in possession of a residence permit in accordance with Section 25a (1) AufenthG, their parents and underage siblings may also be granted a
  • Residence permit, provided that they live together as a family and fulfil the requirements for obtaining a residence permit.

Required documents

  • fully completed application and indication of your ID
  • valid passport, passport substitute or other identity document
  • if applicable, proof of the efforts made to clarify your identity and obtain a valid ID and travel document
  • last three school reports or proof of school leaving certificate or vocational qualification
  • current confirmation of training or employment as well as the last three payslips or certificate of enrolment
  • if receiving benefits, proof of social benefits (benefit notification)
  • Tenancy agreement stating the size of the flat in square metres and statements of account showing the rent amount or a certificate of accommodation
  • for residents of shared accommodation, information on the amount of the accommodation fee (fee notice)

Further documents may be required in individual cases.

If you have been granted admission, the Foreigners Office will issue you with a residence permit.

Tolerated persons can apply for a residence permit with the right of residence opportunity in order to later fulfil the requirements for a long-term right of residence.

Residence permit for the asylum procedure

If you have submitted an application for asylum to the Federal Office for Migration and Refugees, you will receive a residence permit to carry out the asylum procedure.

Health counselling for refugees

We offer health counselling by specially trained staff in accommodation centres. Our employees come to the accommodation centres for this purpose.

Assistance under the Asylum Seekers Benefits Act

Asylum seekers who have little or no income receive economic assistance in accordance with the Asylum Seekers' Benefits Act (AsylbLG).
