Residence permit - Qualified tolerated persons
Do you have a tolerated stay permit and would like to pursue employment that corresponds to your professional qualifications? Then you need a residence permit.
Description
The following regulations only apply to you if you are not from the EU, Norway, Iceland, Liechtenstein or Switzerland.
Residence registration
You must first register your place of residence in Munich at thecitizens' office.
Application and appointment
To apply and make an appointment, please send us your application form and the required documents online or by post. After we have checked your application, you will receive an appointment for a personal visit.
Period of validity
The residence permit is issued for two years. It can be extended for any employment, i.e. also for employment that does not correspond to the professional qualification, after two years of employment corresponding to the qualification.
Tolerated persons with a tolerated stay for training are entitled to a residence permit after successfully completing their qualified vocational training. This only applies to employment corresponding to the acquired professional qualification for a period of two years if the requirements are met.
Prerequisites
- You have
- completed a qualified vocational training programme or a university degree in Germany or
- with a recognised foreign university degree (see anabin or certificate assessment of the Central Office for Foreign Education - ZAB) have been working in Germany for two years without interruption in an occupation commensurate with the degree, or
- qualified vocational training acquired abroad and qualified employment in Germany for an uninterrupted period of three years.
- You have not received any public funds for your living expenses in the year prior to applying for a residence permit (with the exception of costs for accommodation and heating)
- You have sufficient living space
- You have German language skills at least at level B 1 of the Common European Framework of Reference for Languages (CEFR)
- You have not deliberately misled the Foreigners Office about circumstances relevant to residence law
- You have not wilfully delayed or obstructed official measures to terminate your stay
- You have no links to extremist or terrorist organisations and do not support them
- You have not been convicted of an intentional criminal offence committed in Germany; fines totalling up to 50 daily rates or up to 90 daily rates for criminal offences that can only be committed by foreigners under the Residence Act or the Asylum Act are generally not taken into account
Required documents
- Fully completed application form
- Valid passport or passport substitute
- Biometric passport photo(only at the appointment, photo machines can also be found at the Foreigners Office)
- Last three proofs of income
Proof of sufficient living space:
Sufficient living space is available if twelve square metres of living space are available for each family member over the age of six and ten square metres for each family member under the age of six and if ancillary rooms such as the kitchen, bathroom and WC can also be used.
- Rental agreement or purchase contract stating the size of the flat (number of square metres)
- Proof of the current monthly costs for the flat
In the case of rented flats, a current confirmation from the landlord or bank statements showing the amount of rent; in the case of owner-occupied flats, proof of instalment payments for loans and monthly housing benefit.
Education and work:
- Certificate or certificate of completion of vocational training or
- Certificate of study and proof of qualified employment in the last two years
- Proof of qualified employment in the last three years
- Certificate of German language proficiency at level B 1 of the Common European Framework of Reference for Languages (CEFR) (only required if the qualified vocational training or university degree was not successfully completed in Germany)
- Contract of employment
- Fully completed declaration of employment(please upload together with the employment contract)
- Fully completed declaration of employment
- Appropriate pension scheme (required from the age of 45 if the salary is not at least EUR 49,830 gross per year (2024)): Salary may be lower if proofof assets or pension insurance from public or private sources in Germany or abroad is provided

If you have completed vocational training, you may work in an occupation that is appropriate to your qualifications. Helper and trainee occupations are not permitted. For regulated professions, you require a separate licence (professional licence).

A regulated profession is a professional activity for which access to or exercise of the profession is bound by legal and administrative regulations to the possession of certain professional qualifications; one type of exercise is in particular the use of a professional title.
Example: A doctor needs to be recognised in order to practise her profession in Germany. An engineer may also work as an engineer without being recognised. However, he may not call himself an engineer. They are only authorised to use the professional title once they have been recognised.
qualified vocational training exists if it is vocational training in a state-recognised or comparably regulated training occupation for which a training period of at least two years is stipulated by federal or state law.
