Offences against compulsory education

Anyone who violates compulsory school attendance must expect to be fined.

Course description

School attendance is compulsory in Munich. Anyone who is absent from school without a valid excuse can be fined. This is the responsibility of the fines office.

Compulsory schooling usually lasts twelve years: nine years at a full-time school and three years at a vocational school. School is not only a duty, but also a right: it enables education, participation and future opportunities - for everyone.

If pupils are absent without a valid excuse, this will be reported to the fines office. Proceedings can then be initiated. You will then receive a hearing letter with a request for a statement. Respond quickly - you may be able to avoid a fine.

If a fine is imposed and the accusation is true, you must pay the entire amount (fine and ancillary costs) stated in the notice to the city treasury within a certain period of time.

Prerequisites

Fine proceedings can be initiated if the following conditions are met:

  • Compulsory school attendance exists- for children and young people of compulsory school age.
  • There is an offence against compulsory school attendance- this can be
    • unexcused absence from school
    • or: A child does not attend the compulsory German preparatory course, although this has been ordered.
  • There is no valid excuse- for example, no medical certificate or other comprehensible reasons.

Questions & Answers

You can transfer the fine to the City Treasury account, quoting the cash account number.

If you are unable to pay the fine immediately, you can apply for payment in instalments at the city treasury or the fines office. Young people or young adults can also apply to do community service instead of paying. All the necessary forms can be found under "Links and downloads".

You can lodge an objection with the fines office within two weeks of receiving the notice - in writing with a signature or in person at the fines office. Important: Please give reasons for your appeal. If it is justified, the proceedings will be discontinued. If not, the local court will decide on the case.
