Residence permit for the asylum procedure

If you have submitted an application for asylum to the Federal Office for Migration and Refugees, you will receive a residence permit to carry out the asylum procedure.

Description

The residence permit is a document that is issued during the asylum procedure. It certifies that residence in Germany is authorised for the purpose of carrying out the asylum procedure. The residence permit contains personal details and a biometric photograph.

It can be issued and extended for a maximum of 6 months. Conditions and ancillary provisions regarding employment, residence obligations and spatial restrictions are entered in the residence permit. It contains the date of the asylum application and the file number under which the asylum application is being processed at the Federal Office for Migration and Refugees (BAMF).

The residence permit expires automatically when the BAMF decision has become enforceable.

The Munich Immigration Office is only responsible for issuing or extending the residence permit if you are registered in the city of Munich and the Central Immigration Office of Upper Bavaria has transferred responsibility for you to us.

A reallocation exists if you have received an allocation notice from the government of Upper Bavaria for the state capital of Munich.

A reallocation exists if you have submitted an application for reallocation to the foreigners authority previously responsible for you and your move to Munich has been authorised.

You must first register your main place of residence in Munich with the Citizens' Office.

Prerequisites

  • Registration of main residence in Munich
  • You have submitted an asylum application to the Federal Office for Migration and Refugees (BAMF).
  • You do not live in the Munich Arrival Centre or one of the accommodation dependencies

Required documents

  • Current biometric passport photo
  • Current residence permit (if available)
  • Current proof of arrival or certificate of registration as an asylum seeker/ BüMA (for new assignments)
  • Part 1 of the transcript of the asylum application from the Federal Office for Migration and Refugees (for new assignments)
  • Notice of allocation from the Government of Upper Bavaria (for new allocations)
  • Registration certificate of residence in the city of Munich (in the case of reallocation or redistribution )
  • Declaration of the Central Foreigners' Registration Office on the transfer of responsibility (in the case of reallocation, if available)
  • Notification of the approved application for redistribution from the Government of Upper Bavaria (in the case of redistribution)
  • Notification of authorisation to take up private residence (if applicable and available)
  • If you would also like to apply for a work permit: Declaration of employment
  • If you would like to start an in-company training programme: Training contract with stamp of the relevant professional association
  • Birth certificate or birth certificate or extract from the register of births (only if first issued for a newborn child in Germany)

Questions & Answers

Gainful employment is not permitted within the first three months of applying for asylum.

Among other things, gainful employment is not possible if you come from a safe country of origin.

After three months, you may start working with the approval of the foreigners authority and the employment agency.

To do this, please send us the "Declaration of employment" form by online application or by post.

You are not allowed to be self-employed.

Within the first three months of applying for asylum, you will need authorisation from the BAMF if you are living in a reception centre. In all other cases, you will need authorisation from the relevant immigration authority. After that, the spatial restriction expires unless you are obliged to live in a reception centre. Travelling abroad is not possible with a residence permit.

You need the authorisation of the Government of Upper Bavaria to move. Please use the form "Redistribution application for asylum seekers".

In order to move out of the shared accommodation and into a flat, you need the authorisation of the Aliens Department. You can upload the application via our contact form.

Within the first three months after applying for asylum, you are not allowed to start a company-based training programme.

Training is not possible, for example, if you come from a safe country of origin.

You need the approval of the immigration authority. The training programme can be approved at the earliest six months before it begins. To apply, please submit the training contract via online application.
